OBJECT
These general conditions regulate the contracting of Auria
Lockers' lockers in its establishment located at Rúa Santo Domingo, 45 local 2
in Ourense. Likewise, these conditions regulate the contractual relationship
between Auria Lockers and the User who contracts the locker room service.
OUR LOCKERS
Auria Lockers offers its Users the possibility of renting
any of its lockers for periods of 24 hours.
Auria Lockers offers a total of 29 lockers, with 3 sizes,
and 3 different prices (VAT included):
9 Lockers size M: 49'8cms (W) x 37'7cms (H) x 58cms (D), 8€/
24h.
10 Lockers size L: 49'8cms. (W) x 47'2cms. (H) x 58cms. (D),
10€/ 24h.
10 Lockers size XL: 49'8cms. (Width) x 85'5cms. (Height) x
58cms. (Depth), 14€/ 24h.
In the lockers, users may bring in any items they wish, as
long as they do not contradict what is established in the Limits of Use.
Lockers can be rented for a minimum period of 1 day (24
hours).
During this period, users may access their belongings as
many times as they want or need, every day of the week, 24 hours a day.
PRICE
The prices applicable to each type of locker are those
indicated on the website on the date of the order. All prices shown on the
website are inclusive of VAT (Value Added Tax), and correspond to the rental of
one locker for 24 hours.
The offers will be duly marked and identified as such,
conveniently indicating the previous price and the price of the offer.
Auria Lockers may make any modifications it deems
appropriate at any time, depending on its needs and market conditions.
OPERATION
At Auria Lockers we have intelligent lockers where the
entire booking and use process is carried out automatically. In order to hire
lockers at Auria Lockers, you must meet the following requirements:
- You must be over 16 years of age.
- Accept these general conditions for contracting the
service and use of the lockers.
- Accept the privacy policy of Auria Lockers, as the owner
of the lockers.
MODIFICATION, CANCELLATION AND REFUND OF SERVICES
For bookings made at our premises, it will only be possible
to cancel or modify the rental provided that payment has not been made.
INCIDENT MANAGEMENT
In the event of breakdown, blockage or any other type of
incident in the use of the locker, the User will have the Auria Lockers
assistance service at their disposal, which can be used by writing by whatsapp
to the number 604033361, or by means of written communication to the following
address info@aurialockers.com.
RESERVATION FORM
The User guarantees that all the data concerning his/her
identity, as well as the reservation provided are true, exact and complete.
The personal data provided will be used to manage the
booking and to comply with the obligations arising for the parties to the
storage service, www.aurialockers.com. is entitled to process the personal data
provided in the contracting process by the User as they are necessary for the
provision of the service. By contracting, the User expressly consents to the
processing of his/her personal data in the terms detailed herein.
OBLIGATIONS OF THE USER
To use the lockers only as a place for the temporary storage
of goods belonging to him/her.
To use the lockers correctly, without damaging them, and to
ensure that the locker is locked when the user leaves the premises.
This implies a commitment to use the lockers for legal and
authorised purposes, undertaking not to store objects whose mere possession or
trafficking is illegal (stolen objects, drugs, etc.).
Likewise, not to introduce flammable, polluting or dangerous
materials or living beings into the lockers.
If any material that is deposited in the lockers requires a
permit or licence for its possession, to have that licence.
Do not bring in food or drink that is not packaged. Do not
include in the lockers money, jewellery, technological items (tablets,
computers, televisions, etc.) or goods of special value, being the sole and
exclusive responsibility of the user the decision to use the rented lockers to
store this type of goods of special value.
Remove the packages placed in the rented lockers before the
end of the rental period, i.e. before the end of the 24-hour period reserved.
If you do not do so, you must pay the amount of the corresponding time slot in
order to be able to open your locker. Leave the lockers at the end of the
service in the same condition in which they were found. Notify Auria Lockers of
any incident detected in the lockers or in their condition at
info@aurialockers.com.
IMPORTANT
Do not exceed with your luggage the line marked inside the
lockers, nor their capacity. Do not force the door when closing the locker.
This could block the door, preventing it from opening.
Do not give the password to third parties, and the user will
be held responsible for any breach of these obligations. Not to use the lockers
to exchange goods with third parties.
To enter the premises only for the purpose of accessing the
lockers, without remaining on the premises for longer than is strictly
necessary.
Not to take photographs or recordings of the security
mechanisms of the premises.
CONSEQUENCES AND LIABILITY OF THE USER IN THE EVENT OF
NON-COMPLIANCE WITH THEIR OBLIGATIONS
The User shall hold Auria Lockers harmless for any damages
arising from the breach of its obligations under this contract.
Failure to comply with the rental period
In the event of non-compliance with the rental period, and
depending on the availability and demand at the time, Auria Lockers may empty
and release the user's lockers and store the packages in its warehouse in order
to subsequently manage their return.
The amount to be paid by the user for each day that elapses
from the expiry of the rental period, if the lockers have not been released,
will be the equivalent to the price of the locker.
If 10 days after the end of the rental period it has not
been possible to contact the user, it shall be understood that the goods have
been abandoned by the user, and Auria Lockers may therefore cease to keep them,
giving them the disposal it deems appropriate or convenient depending on the
type of goods abandoned.
In the event that the User is contacted and his or her
belongings have to be returned, a penalty of €150 shall be accrued, to be paid
by the User to Auria Lockers, regardless of Auria Lockers' right to claim for
damages suffered. When Auria Lockers delivers the packages to the carrier, the
responsibility shall be the responsibility of the User, and Auria Lockers shall
not assume any risk for the transport of the packages.
Non-compliance with the proper use of the lockers
The User will be responsible for the objects he/she puts in
the lockers.
If the user, when storing their belongings, exceeds the
capacity, exceeds the line marked on the inside, and/or forces the door shut
when closing the locker. In this case, it is possible that the locker door will
be blocked and cannot be opened when collecting luggage. If this happens, the
user must contact us and we will attend to the incident. The cost of this
management / assistance will be 30€.
In any case, the removal of the prohibited items will entail
a penalty of 150€, a penalty that will not exclude the obligation of the
non-compliant User to compensate Auria Lockers for the damages actually caused.
Payment of penalties
The penalties detailed in this section shall be paid by the
User by the same means of payment used by the User when contracting the
service, or by the means considered most appropriate at the time by Auria
Lockers.
Damage caused to the lockers by Users
The User shall be fully responsible for any damage or
deterioration that may be caused to the lockers due to improper or
inappropriate use. Where applicable, the User shall compensate Auria Lockers
for any physical damage caused to the locker/s as well as for loss of profit.
In particular and without limitation, the User causing the
damage shall pay Auria Lockers a penalty of the daily rent for each day that
the locker is unusable, as well as the cost of repair or replacement, which is
quantified in the case of replacement at €1,500, regardless of the damages
caused.
OBLIGATIONS OF AURIA LOCKERS
Auria Lockers undertakes to maintain the locker service
active and to make available to the User, during the contracted time, the
locker or lockers that the User has contracted in a good state of use.
Likewise, Auria Lockers undertakes to resolve any incident that may arise in
the use of the lockers as soon as possible.
LIMIT OF LIABILITY OF AURIA LOCKERS AND INSURANCE
Auria Lockers offers a locker space rental service and is
not responsible for the custody of the packages. The User is solely responsible
for the goods included in the rented lockers. In the event of theft, the User
must file a report with the competent authorities.
Notwithstanding the above, in the event of theft, Auria
Lockers has an insurance contract in favour of users that covers losses due to
theft up to a maximum amount. In order to receive this benefit should it occur,
the user must comply with the requirements listed in the policy and work with
Auria Lockers to submit the claim to the insurer. The user must specifically
and without exception, in the event of theft, file a report with the
authorities.
This insurance does not cover the loss of money, jewellery,
precious stones or metals, watches, plasma screens and in general technological
items (LCD, GPS navigators, mobile phones, computers, tablets), objects of art,
antiques, credit cards and other items of personal property.
COMPLAINTS
In the event that the User considers that he/she has grounds
for lodging a complaint, he/she may do so by sending an e-mail to the following
address: info@aurialockers.com.. Auria Lockers will try to resolve the incident
and seek a satisfactory solution for both parties.
If the User is not satisfied with Auria Lockers' response,
he/she has the option of submitting a complaint form to the consumer
authorities of the Xunta de Galicia.
APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions are governed by Spanish
law. The parties submit to Spanish jurisdiction to resolve any dispute arising
in connection with this Contract.
